Automobile Accidents and Injuries

An automobile accident is a road traffic incident which usually involves at least one road vehicle being in collision with, either another vehicle, another road user, or a stationary roadside object, and which may result in injury or property damage.

Determining fault for causing an accident is either created by statute or defined by common law. There are four basic levels of fault that is recognized by Common law:

1. negligence
2. recklessness or wanton conduct
3. intentional misconduct
4. strict liability (irrespective of fault)

Under common law, a “tort” (i.e., A legal term denoting a wrongful act resulting in injury or damage on which a civil court action, or legal proceeding, may be based) is committed when an individual has caused an automobile accident a private wrong against another.
