Product recall of children's toys affects Montana

Commonly, gifts during the holidays include shoes, clothes and toys. Some people prefer to give toys to the children to bring wide smiles to their faces. However, the fact that toys can be the source of happiness to children does not mean that they are never hazardous.

A recent product recall of toys that were sold by retailers located in all 50 states, including Montana, may alarm consumers about these dangerous children's toys. The report may also introduce products liability to the public.

According to the report, the U.S. Consumer Product Safety Commission recalled the toys called Water Balz, Growing Skulls, H2O Orbs and Fabulous Flowers. The product recall affects the nearly 94,000 toys that were sold throughout the U.S. The toys are small in the package and grow in water. The Commission stated that the toys can cause vomiting, dehydration and can even death to a child if swallowed. If a child ingests these toys, surgery may be required to remove it.

Apparently, it was reported that an eight-month-old baby from Texas ingested a Water Balz toy. As a result, the infant needed surgery to remove the object.

Product manufacturing should not only address quality but also safety. Safety should be a primary concern of product manufacturers because any defects or hazards may endanger a life. If a product was proven defective and poses a risk to the users, failure to ensure safety may be considered negligence. Negligence may hold a manufacturer or distributor legally responsible for the damages if an accident occurs.

Victims of product liability cases may be eligible for compensation if the manufacturer's negligence contributed to the incident. The injured party may be compensated for medical costs, therapies and other necessary expenses. The compensation may continue until the victim is fully recovered. In the event of a fatality, the victim's family, who likely also suffered emotional distress, may receive compensation for pain and suffering.
