Novartis' syrup may give rise to products liability case

Families in Billings, Montana, assume that the medicines they buy at the drugstore are intended to cure certain medical conditions. Since a person's health depends on these drugs, manufacturers must exhibit extreme care in their packaging and production. If manufacturers fail to guarantee that their products are free from defects and are not hazardous to human health, they may be vulnerable to products liability cases.

In Montana, products liability cases may revolve around defective automobile parts, defective equipment and defective prescription drugs if such products contribute to the injury or death of another person. A close investigation is needed to prove how the defective product caused the personal injury, which is one reason why a plaintiff may need legal representation.

Billings, Montana residents may be interested in knowing that some bottles of Triaminic and Theraflu were recently recalled. According to one source, a product recall regarding these medications was announced because of defects in their child-resistant caps. Both medications are manufactured by Novartis.

Reportedly, the defect allows the cap to be removed without breaking the seal on the bottle. Novartis stated that they had received four reports related to the defective products. The products were manufactured in a Novartis plant between May 2010 and December 2011. The plant was subsequently closed due to quality control problems cited by federal inspectors.

In such situations, if the dangerous product is a contributing factor to any injuries or fatalities, the injured party may have the right to sue the manufacturer in a product liability case. The plaintiff must prove that the product manufacturer was negligent in ensuring the safety of their products. A attorney experienced in dealing with such product liability cases would be a valuable asset to a victim of such defective products.
